New Delhi: Leader of opposition in the Lok Sabha Sushma Swaraj on Tuesday demanded that the Lokpal Bill should be withdrawn, claiming that there were flaws and inconsistencies in the proposed legislation to deal with corruption.
"The Bill should be withdrawn. No need to pass it in a hurry. Send it back to the Standing Committee. Reintroduce it after 3-4 months. We wanted the Bill in this session. But, we did not want this type of Bill," she said.
"Sad to say that the Bill is inadequate. The Bill has lot of flaws, lot of inconsistencies. We expected government to bring a bill that will remove corruption. But the bill has ruined our expectations. It violates the Constitution," the BJP leader said.
Giving credit to the Anna Hazare movement, she said, "Anna's agitation has given heat to the Lokpal issue."
Showing dissent over the government's Lokpal draft, she said, "It can't go against the basic structures of the Constitution. This bill is talking of Lokpal and Lokayukta both. State employees will be looked after by Lokyukta. The bill can't force states to follow the diktat of the Centre."
"You want to make it mandatory and at the same time claim that you want to make it optional. Government is confused as two different ministers speaking in two different voices," she said.
"If you pass the Bill under mandatory article, how can you expect states to exercise their discretionary powers?," she asked.
Mandatory law is an attack on federal structure. Will the government admits that the Bill is full of flaws? This Bill will adversely affect the states, which are fighting corruption," she said.
On the provision of the minority quota in Lokpal, she said, "50 per cent reservation provision in the Bill is against the Supreme Court's verdict on reservation. There is no reservation for constitutional posts."
"Reservation based on religion has also been introduced. It is not acceptable. Without reservation, many people from minority community have held the highest positions in India. Of 12 Presidents, 4 Presidents were from minority communities," she said.
"Five Chief Justices were also from minority communities. Religious Quota will divide the nation," she added.
Taking a dig at RJD Chief Lalu Prasad on reservation, she said, "Lalu does not seem to understand the cunningness of the government. Hope, he will now realise it."
To this, Lalu responded by saying, "BJP wants to divide the country."
On the flaws in the Lokpal Bill, she said, "We acknowledge that top UPA ministers are constitutional experts. How can they introduce such a confusing Bill full of flaws?"
"We wanted the government to free CBI. Government has done exactly the opposite.
Government controls almost every aspects of the Lok Pal. It will serve no purpose. This Lokpal can never be impartial," she said.
On the law for prosecuting the Prime Minister, she said, "In-camera hearing of the Prime Minister won't work in India. It will be abused. It can never be implemented.
This Bill will embarrass the entire nation and the Prime Minister," she said.
On the independence of the country's premier investigative agency, she said, "CBI is at the mercy of the government. It has recently given a clean chit to P Chidambaram. CBI has been misused in Andhra Pradesh to retain majority. Administrative control of the CBI with the Government will make Lokpal useless."
"Government made the whole exercise highly complicated. We can't understand what the government is really going to do," she said.
More specifically, she said, "We want separate investigations and prosecution wing of CBI and financial powers to Lokpal."
She blamed that just to put an end to public movements by civil society the Bill has been introduced.
