Adnan Patrawala murder - Four accused acquitted

Mumbai: Four people accused in the Adnan Patrawala murder case were let off by a Mumbai court on Monday. The accused Sujit Nair, Amit Kaushal, Ayush Bhat, Rajeev Dhariya were acquitted after the prosecution failed to produce evidence in the court linking them to Adnan's murder.

Five people were arrested for Adnan's murder with one of the accused being a minor and his case is being tried in a juvenile court.

The prosecution has decided to challenge the trial court's verdict in the Bombay High Court. Adnan's father and Mumbai builder Aslam Patrawala called the verdict "shocking".

"Very shocking, very shocking. What can I say? Justice has been denied to us. How can they do this? We will go to the higher court," said a distraught Aslam Patrawala.

Sujit Nair's lawyer Ashish Chavan said that the court rejected the conspiracy theory put forward by the prosecution. The court rejected prosecution witness' claim that he heard the accused hatching the plan to kidnap Adnan in a shopping mall.

"All the four accused have been acquitted by the court. The prosecution has failed to produce evidence in the court. The prosecution failed to establish the theory of conspiracy. The entire case is based on circumstantial evidence and the chain of events has not been established. It is still a death, (but) murder has not been proved," said Chavan.

Chavan said there was a contradiction of the witness hearing about the conspiracy in a mall and the recovery of Adnan's body and the court rejected both the points. The court also questioned the prosecutions claims about the recovery of the body.

"Justice has been done today. Both the theories of prosecution have been disbelieved by the court. We have maintained our innocence and we have proved in the court. We have sympathies for the family. The culprits should be punished," said Chavan.

He also pointed put that prosecution failed to support its allegations and claims by evidence in the court.

The theory of ransom has not been proved and call records have not been produced before the court," he added.

Adnan, 16, was killed in Mumbai on August 19, 2007 allegedly by his friends.

The accused had allegedly befriended Adnan. They later kidnapped him and demanded a ransom of Rs 2 crore from his family. Police found Adnan's body on the Palm Beach Road in Navi Mumbai. He had been strangled to death.

The police charged the accused with kidnapping, murder, extortion and destruction of evidence.

If the judiciary will continue to fail delivering justice,people will start taking the law into their hands,especially when it comes to cases like this where a father is seeking justice for his murdered son.If that happens it could be very well the beginning of the end of India as a civilized society.
